Terms and Conditions for Clay Riders Rentals
Welcome to Clay Riders Rentals. These Terms and Conditions govern your use of our motorbike rental services, scooter rental, helmet and gear rental, and guided moto tours. By accessing or using our online platform or engaging in any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. Definitions
- "Company", "we", "us", or "our" refers to Clay Riders Rentals, located at Browning Street, London, City of London, SE17 1EH, United Kingdom.
- "Rider", "Customer", "you", or "your" refers to the individual renting a motorbike or scooter, participating in a tour, or otherwise utilizing our services.
- "Vehicle" refers to any motorbike or scooter rented from Clay Riders Rentals.
- "Rental Agreement" refers to the specific contract signed by the Rider at the time of vehicle collection, which incorporates these Terms and Conditions.
- "Services" refers to motorbike hire, scooter rental, helmet and gear rental, guided moto tours, and any related offerings by Clay Riders Rentals.
2. Eligibility for Rental
To rent a Vehicle from Clay Riders Rentals, you must:
- Be at least 21 years of age for scooters and certain motorbikes, and 25 years of age for high-performance motorbikes (specific age requirements depend on the vehicle class and will be confirmed at booking).
- Possess a valid, full unendorsed motorcycle driving license for at least 2 years, appropriate for the Vehicle class being rented, issued in your country of residence and valid for use in the United Kingdom. International Driving Permits are required for licenses not in English.
- Present a valid credit card in your name for the security deposit.
- Provide a valid identification document (e.g., passport).
3. Booking and Reservations
Bookings can be made through our online platform or directly with our staff. A non-refundable deposit may be required to confirm a reservation. The full rental amount is payable at the time of vehicle collection.
All reservations are subject to vehicle availability and our discretion. We reserve the right to decline any rental request without providing a reason.
4. Rental Period
The rental period commences at the time the Vehicle is collected by the Rider and ends at the agreed return time. Late returns may incur additional charges at the daily rental rate, along with potential penalties.
Short-term and long-term rental options are available, with pricing structured accordingly.
5. Rental Charges and Payment
Rental charges include the cost of the Vehicle for the specified period, basic insurance (details provided separately), and any selected optional extras (e.g., helmets, gear, GPS). Fuel is not included and is the responsibility of the Rider.
Payment can be made via major credit cards or other accepted methods. All charges are in GBP (Β£).
A security deposit will be authorized on your credit card at the time of rental. This deposit covers potential damages, excess mileage, or other additional charges and will be released upon satisfactory return of the Vehicle.
6. Vehicle Condition and Return
The Rider acknowledges receiving the Vehicle in good working order and clean condition. Any existing damage will be noted on the Rental Agreement.
The Vehicle must be returned in the same condition as rented, subject to normal wear and tear, and with a full tank of fuel. Failure to return the vehicle full of fuel will result in a refueling charge plus the cost of fuel.
Damage to the Vehicle, including tires or accessories, beyond normal wear and tear, will be assessed and charged against the security deposit or to the Rider directly.
7. Insurance and Liability
All Vehicles are supplied with basic third-party insurance as required by UK law. This insurance includes an excess amount, which is the Rider's responsibility in the event of an accident or damage, regardless of fault.
Optional additional insurance waivers may be available to reduce the excess liability. Details will be provided upon request and at booking.
The Rider is responsible for any damage or loss caused to the Vehicle, third-party property, or personal injury where our insurance does not cover or where the Rider has violated the terms of the Rental Agreement or performed illegal activities.
The Rider agrees to indemnify and hold harmless Clay Riders Rentals from any claims, damages, liabilities, costs, and expenses arising out of the Rider's use of the Vehicle.
8. Restrictions on Use
The Vehicle must not be used:
- By anyone other than the registered Rider(s) specified on the Rental Agreement.
- For racing, speed testing, or any illegal activities.
- Off-road or on unsuitable terrain unless specifically authorized for guided tours.
- While under the influence of alcohol, drugs, or any substances impairing driving ability.
- To carry passengers or goods for hire.
- Outside of the United Kingdom without prior written consent from Clay Riders Rentals.
9. Accidents and Breakdowns
In the event of an accident, theft, or breakdown, the Rider must immediately notify Clay Riders Rentals (+447975257700) and, if applicable, the police. Do not admit fault or liability to any third party.
Full details of any incident must be provided to Clay Riders Rentals within 24 hours. The Rider is responsible for securing the Vehicle and preventing further damage or theft.
10. Guided Moto Tours
Participation in guided moto tours is subject to our tour-specific terms and conditions, which will be provided at the time of booking. Riders are expected to follow the instructions of the tour guide at all times.
Clay Riders Rentals reserves the right to remove any Rider from a tour if their riding ability is deemed unsafe or if they do not comply with safety rules.
11. Cancellations and Amendments
Cancellations or amendments to bookings must be made in writing. Cancellation fees may apply depending on the notice period given. Our specific cancellation policy will be detailed at the time of booking.
12. Personal Data
We collect and process your personal data in accordance with our Privacy Policy. By using our services, you consent to such processing.
13. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Amendments to Terms
Clay Riders Rentals reserves the right to amend these Terms and Conditions at any time. The most current version will always be available on our online platform. Your continued use of our services after any such amendments constitutes your acceptance of the new Terms.
